Terms & Conditions

1. Ownership and Title

All goods remain the sole property of Westcot Tractors Ltd until payment has been received in full and cleared. Title shall not pass to the purchaser until such time.

2. Nature of Sale

This transaction constitutes a trade sale, and all goods are sold as seen and inspected by the purchaser or their agent.

No warranties or guarantees are expressed or implied. Purchasers accept goods in their existing condition at the time of sale.

3. Payment Terms

• Full payment must be received within fourteen (14) calendar days from the date of invoice.
• All payments must clearly reference the invoice number issued.
• Deposits are non-refundable under any circumstances, unless otherwise agreed in writing by Westcot Tractors Ltd.
• For international buyers:
  • Payment must be made via bank transfer (SWIFT) in GBP (£) unless otherwise agreed.
  • Any bank charges or exchange rate fees are the responsibility of the buyer.
  • Goods will not be released or shipped until payment is received in full and cleared.

4. Cybersecurity Notice

Due to the increasing risk of cybercrime and fraud, buyers are strongly advised to verify all bank account details by direct phone call to our office before making any payments. Westcot Tractors Ltd shall not be held liable for any losses resulting from fraudulent payment instructions.

5. Storage Terms

If goods are not collected or shipping is not arranged within thirty (30) days of the invoice date, the buyer will incur storage charges, invoiced weekly at prevailing rates. Continued failure to collect may result in resale as per the default clause below.

6. Freight and Transport

• All transportation, shipping, and freight costs are to be paid by the purchaser in full, prior to any release or dispatch of goods.
• The purchaser is responsible for arranging and complying with customs, export documentation, insurance, and local import regulations.

7. Default and Resale Clause

If full payment has not been received within twenty-eight (28) calendar days from the invoice date:

• Westcot Tractors Ltd reserves the right to resell the goods without notice.
• Any funds already received will be used for administrative, storage, and resale costs, with any balance refunded at our sole discretion.
• This clause is enforceable without prejudice to any further legal or financial remedies available to Westcot Tractors Ltd.

8. Jurisdiction and Governing Law

This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts, unless alternative arbitration or dispute resolution has been mutually agreed in writing.
